How long does trademark registration take in India?
Typically 12 to 18 months from filing to registration certificate, assuming no objections or third-party opposition. The ™ symbol can be used immediately after filing, well before registration completes.
What happens if my application receives an objection?
You must file a written reply within 30 days of the examination report. TradeGuard IP drafts the reply, supports it with relevant case law, and appears at a show cause hearing if required. Missing this deadline can result in the application being abandoned.
Do you handle patents and copyrights too?
Yes. Alongside trademarks, we handle Patent registration and prosecution, Copyright registration for literary/artistic/software works, and Design registration for product appearance.
How much does trademark registration cost?
Government fees are ₹4,500 per class for individuals/startups, or ₹9,000 per class for companies. Professional fees vary by scope of work – contact us for a free consultation and quote.
Can I use the ™ or ® symbol right away?
You can use ™ immediately after filing your application. The ® symbol can only be used once the registration certificate is actually issued – using it earlier is a legal offence under the Trade Marks Act.
Do you work with clients outside Kerala?
Yes. All filings happen through the IP India online portal and hearings are conducted via video call, so we handle matters for clients across India, not just Ernakulam.
